Le travail clandestin est interdit.
\n\u2014\u00a0C. trav., art. Lp. 5611-2 al. 1er<\/i><\/p>\n
\n\u00a0l\u2019employeur n\u2019a pas proc\u00e9d\u00e9 \u00e0 la d\u00e9claration nominative pr\u00e9alable \u00e0 l\u2019embauche de chaque travailleur qu\u2019il emploie\u00a0;
\n\u00a0l\u2019employeur ne remet pas un bulletin de salaire \u00e0 chacun des travailleurs qu\u2019il emploie, lors du paiement de sa r\u00e9mun\u00e9ration\u00a0;
\n\u00a0il n\u2019a pas proc\u00e9d\u00e9 aux formalit\u00e9s obligatoires d\u2019enregistrement de l\u2019activit\u00e9 qu\u2019il exerce ou aux d\u00e9clarations fiscales, parafiscales ou sociales inh\u00e9rentes \u00e0 sa cr\u00e9ation ou \u00e0 sa poursuite\u00a0;
\n\u00a0l\u2019employeur d\u00e9livre, m\u00eame avec l\u2019accord du travailleur, un bulletin de salaire mentionnant un nombre d\u2019heures de travail inf\u00e9rieur au nombre d\u2019heures r\u00e9ellement effectu\u00e9es, ou d\u00e9clare \u00e0 la caisse de pr\u00e9voyance sociale un nombre d\u2019heures de travail inf\u00e9rieur au nombre d\u2019heures r\u00e9ellement effectu\u00e9es.

Le donneur d\u2019ordre doit \u00e9galement s\u2019assurer du respect par ses sous-traitants de leurs obligations en mati\u00e8re de d\u00e9claration de leurs salari\u00e9s \u00e0 la Caisse de pr\u00e9voyance sociale.
